and a stunning sight as a bird of prey swoops out of the air and almost makes off with a small child. captioning funded by cbs this is the "cbs morning news" for wednesday, december 19th, 2012. good morning, everybody. good to be with you. i'm terrell brown. the state department is getting its har shift review yet for the terrorist attack. a panel charged with investigating the incident concludes that the state department failed to provide adequate security at the compound. four americans were killed there on september 11th, including ambassador chris stevens. tara mergener is in washington this morning with more. good morning, tara. >> good morning to you. well, the state department released unclassified portions of the report last night. investigators offered harsh criticism of the state department but did not single out any individual u.s.

individuals for blame. the review board was headed up by retired ambassador thomas pickering and former chairman of the joints chief of staff, admiral mike mullen. they'll discuss their findings with lawmakers today. the panel blamed systematic failures and leadership and management deficiency in two bureaus of the state department for security measures at the benghazi compound that were described as inadequate. the report concluded that while there were no specific threats of a terrorist plot, there were several incidents leading up to the september 11th attack that should have served as warning signs. investigators also praised the diplomatic security agents who responded to the attack and absolved the pentagon for any blame, saying there was not enough time for military assets to have made a difference. the board also made 29 recommendations to improve security at u.s. diplomatic missions around the world. they include increasing the number of marine guards at each post, relying less on local security forces, and hiring more

highly trained diplomatic and trained security personnel. now, secretary of state hillary clinton sent a letter to lawmakers saying she accepts all of the recommendations in the report and has already starting implementing some of them. now, she was supposed to appear at a hearing on benghazi thursday but canceled after fainting, terrell, and sustaining a concussion. >> tara mergener in washington. this morning. tara, thank you so much. the national rifle association plans to hold a news conference on friday on the one-week anniversary of the school shootings in newtown, connecticut. the nation's most powerful and outspoken gun lobby broke its silence tuesday releasing a short statement. meanwhile funerals are being held and school resumes more most of the schools. marley hall is live this morning. good morning to you. >> good morning, terrell. while the motive behind this

tragic shooting remains unclear, one thing is for sure. emotions are still raw here in newtown, connecticut. five funerals are scheduled for today in this one small town, and people are still reeling. hundreds gathered for a memorial service to remember sandy hook elementary school principal dawn hochsprung. she died trying to stop the shooter after he broke into the school. >> you don't have to know her. you just have to know what she did was an act of selflessness and that touches humanity. >> reporter: hochsprung's funeral is just one of five that will be held today. tuesday more were laid to rest. james mattioli loved sports and math. he was a numbers guy. jessica rekos loved horses. she wanted a cowgirl hat for christmas. yesterday was a day of mixed emotion for many parents and students as school reopened in newtown for everyone except the kids who attended sandy hook

elementary. >> it was so surreal. >> reporter: there were some that stayed away. >> my neighbor up the street, she -- her kid didn't come back. >> reporter: but there was also this. smiles from children who appeared to be happy to be going back to school. the tragedy here has reopened a debate on what kind of guns should be allowed in society with many now taking a new look at the issue. there's a ground swell of support in washington, d.c., to look at new laws that would ban magazines that hold dozens of bullets at a time, even from pro gun legislators. >> i go hunting. i never put more than three shells in my clip. it holds five. >> reporter: even the national rifle association chimed in to say the nra is prepared to offer meaningful contributions to make sure that this never happens again. white house spokesman james carnie says the white house will actively support a bill to reinstate the assault rifle ban that expired in 2004.

terrell. >> thank you so much. meanwhile we're learning more about the gunman, 20-year-old adam lanza. authorities say it's unlikely they'll be able to retrieve information from lanza's computer. it was too badly damaged. and federal agents say lanza practiced target shooting with his mother at the local gun ranges. a scholarship has been set up at the university of connecticut. it will help pay the college costs for sandy hook students who choose to attend uconn. students of the victims and a children of adult victims will also be available. this morning a major winter-like storm -- it isn't officially winter until friday, but that storm moving from the northwest and to the plains and will likely affect holiday travel. the winter storm warnings and watches are posted from oregon to michigan. heavy snow and high winds are expected in colorado, utah, and parts of arizona. highway and air travel delays are expected. two fiscal cliff negotiations now. speaker john boehner is pushing ahead with a plan separate from

the one he's trying to negotiate with president obama. he calls it plan b. the white house and democratic leaders have already rejected boehner's idea. nancy cordes has the details now from washington. >> our plan b would protect the american taxpayers. >> reporter: speaker boehner says he'll take his plan directly to the house floor with a bill to extend the low bush cut tax rates for all americans making less than $1 million a year. that's far higher than the $400 income cut-off the president is currently proposing, higher still that president obama's campaign promise to let taxes rise on households make 2g $50,000 or more. boehner said he has to bypass talks with the white house and pull the vote on his plan now because the president's latest fiscal cliff proposal still isn't balanced between taxes and cuts. >> what is your definition of a balanced deal? does it have to be dollar-for-dollar spending cuts on tax revenue increases?

>> most people would agree it's balanced. >> reporter: but can it just be close to that, or does it have to be exactly equal? >> we do not have a balanced plan when the president's calling for $1.3 trillion in revenue and only willing to put $850 billion worth of cuts over ten years. >> reporter: democrats call boehner's plan b a farce that undermines delegates' negotiations. senate leader harry reid. >> it can't pass the senate and it doesn't do anything. >> reporter: the president's latest proposal dropped an extension of the payroll tax cut next year, so even if most working americans don't see an increase in their income tax rate next year, they could still see an increase in their tax bill of about $1,000 for the average worker. nancy cordes, cbs news, capitol hill. >> we'll take a quick break on a wednesday morning. when we come back, some of the first responders at the scene of the sandy hook shooting share their heart-wrenching stories from the day of the

milo's kitchen home-style dog treats. 6-year-old katherine hubbard, one of the victims of the sandy hook elementary school will be laid to rest tomorrow. her parents released a statement expressing gratitude to the emergency responders. elaine quijano spoke to some of the people who were among the first to show up to the school that friday. >> police that were in there were calling for as many ambulances as possible. >> reporter: assistant fire chief ray corvo and firefighter rob manna got the dispatch call just after 9:30. >> well, like with any call, you kind of develop an image in your head to prepare yourself for what you may be coming into, you know. it certainly wound up to be much more than, you know, i developed in my mind. >> there was nobody to treat. one or two early on, and then

our whole triage unit that were expecting to get multiple victims -- never. we didn't get any. >> can you talk about what you felt when you saw what you saw? >> what seemed to bother me the most was the parents down at the staging area. >> what about them? >> they were showing up faster than law enforcement really. they were coming from all directions, panicked. as the children were coming down, they were looking to claim their child, and as they would get their child, they would leave, and we knew that there was a certain amount of kids inside there that wouldn't going to be coming out on their own power, and those were the parents. they were waiting. they never came. >> you're the parent of a 7-year-old. >> correct. >> reporter: how does that affect you?

>> it could have been my son. same grade. we lived in that district just two years ago. >> reporter: have you told him about what happened? he's 7 years old. he doesn't need to know this. >> reporter: what do you want to say to all the families? >> i don't have any words. i don't know. i i'm sorry. i'm sorry that we couldn't help more. >> elaine quijano, reporting this morning. the trial of two bp rig supervisors has been delayed for over a year. robert kazula and donald vidrine are charged in the explosion that led to the death of 11 workers. it happened on the deepwater horizon in april of 2010. their lawyers say they need more time to go through more than a million pages of information prosecutors plan to give them. the trial had been scheduled for february. it will now be held in january of 2014. coming up next, your wednesday morning weather and something to chew on. the maker of gummy bears wins a

more hope over the fiscal cliff negotiations fueled another strong day on wall street. the dow added 115 points while the nasdaq gained 43. shares of publicly traded gun makers were down in the wake of the connecticut school shooting, and the company that makes the weapon believed to have been used in the shooting is now up for sale. meanwhile gun shop operators have been reporting an uptick in sales. some have indicated the sales bump is due to customers buying weapons now before any new gun control legislature can be enacted. instagram is backing off a new policy that allowed it to use photos from user accounts and advertisements. it comes after an online backlash from its users and privacy advocates. despite changing its stance, instagram's co-founder said the service was created to eventually make money and it will experiment with various forms of advertisen't. and victory is sweet for the candy company that makes gummy bears. a german court ruled in favor of haribo in a trademark case

worldwide reaction to the sandy hook elementary school has been one of outrage and grief. in one town in scotland, this tragedy is all too familiar. elizabeth palmer reports. >> reporter: dunblane was a quiet little town nestled in forested hills until calamity struck. on march 13, 1996, panicked parents rushed to the dunblane primary school where 43-year-old thomas hamilton had opened fire in the gym. 16 5- and 6-year-olds and

theirers were killed, including matthew bernie who was shot in the test. more than a decade later, his father steve heads the done blaine community center from money donated to the town after the shooting. on the windows there's a motif for every child who died. the victims and their families found plenty of love and support in done blaine, but in the end as steve bernie found, grief is a long and very private journey. >> people will grieve in different ways and at different times and to not necessarily assume that people are over it because for some people, it will take an awfully, awfully long time, and the slightest thing can reopen the wounds and the hurt. >> reporter: some of the anger and resentment was channeled into an anti-gun lobby which did eventually win an almost blanket ban on the private ownership of handguns in the uk. and then this summer the

community turned another corner. andy murray, the tennis champion, who survived the dunblane massacre by hiding under a desk won gold at the london olympics. for dunblane at latest there was a joyful legacy to balance its terrible stigma. but as soon as the news of the sandy hook elementary school shootings broke, old wounds reopened. >> obviously our hearts go out to them. and -- sorry. i'm not really giving them the best for someone who's moved on, but i think out of the most tragic circumstances, some good does appear, and hopefully that will happen for them. >> reporter: at the dunblane community center, they're lighting candles of condolence and sending sympathy from one of the only places on earth that really understands the depth of newtown's grief.
